Use Agreement
LHFS offers the services available on our sites conditioned upon your acceptance of all the limitations of use and prohibited activities set forth below (collectively, the Use Agreement). By using the LHFS sites in any manner, you accept and agree to be bound by this Use Agreement. Your continued use of LHFSs web sites is your acceptance of the changed or modified Use Agreement.

Limitations of Use
Any site offered and operated by LHFS, and any Company Information provided thereon, is available to you only for the purpose of originating and submitting a mortgage loan application to LHFS in order to determine the acceptability of such file by LHFS. Without a specific written approval or loan lock delivered separately to you, nothing on this site shall be construed to be locking a particular interest rate, or providing loan approval or a commitment by LHFS to approve and fund a mortgage loan. Other than the scope a corresponding mortgage loan transaction with LHFS for which you are using this site, you are not authorized to use the information provided on this site for any other commercial use or other purpose without the specific written consent of LHFS.

LHFS is not liable for information that is inaccurate due to technical defects in software used on our web site, whether induced by our systems or by software provided by third parties.

If LHFS notifies you that the manner in which you are using one of the LHFS sites is prohibited or unauthorized, you may no longer use the site for that particular purpose.

Prohibited Activities

You may not disguise the origin of information transmitted to, from, or through the LHFS sites. You may not circumvent any measures implemented by LHFS aimed at preventing violations of the Use Agreement. You may not violate the restrictions in any robot exclusion header.

When you use the LHFS sites or Company Information for an authorized purpose, you must include all proprietary notices without changing, hiding or deleting them.

You may not engage in any conduct that is, or that LHFS deems to be, in violation of this Use Agreement.

You further grant LHFS the right to pursue at law any person or entity that violates LHFSs rights as set forth herein.

You shall be solely liable for any damages resulting from any violation of the foregoing restrictions, or any other harm resulting from your posting of content to this web site.
Intellectual Property Rights

LHFS respects the intellectual property of others, and we ask our users to do the same. It is our policy, in appropriate circumstances and at our discretion, to disable and/or terminate the accounts of users of the LHFSW or other LHFS site(s) who may infringe or repeatedly infringe the copyrights or other intellectual property rights of LHFS and/or others.

IN NO EVENT SHALL LHFS OR ITS AFFILIATED COMPANIES BE LIABLE FOR ANY DAMAGES (WHETHER CONSEQUENTIAL, DIRECT, INCIDENTAL, INDIRECT, PUNITIVE, SPECIAL, OR OTHERWISE) ARISING OUT OF, OR IN ANY WAY CONNECTED WITH, A THIRD PARTYS UNAUTHORIZED ACCESS TO YOUR PRIVATE INFORMATION, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, STRICT LIABILITY, TORT, OR OTHER THEORIES OF LIABILITY, AND ALSO REGARDLESS OF WHETHER LHFS WAS GIVEN ACTUAL OR CONSTRUCTIVE NOTICE THAT DAMAGES WERE POSSIBLE.

Some jurisdictions do not allow the exclusion of consequential or incidental damages, so portions of the above exclusions may not apply to you.

Our Legal Rights

Forum Selection
These Terms and the relationship between you and LHFS shall be governed by the laws of the State of California without regard to any conflict of law provisions. You agree to the personal and exclusive jurisdiction of the courts located within Contra Costa County, California. You hereby consent to the exclusive jurisdiction and venue of the State and Federal courts in Contra Costa County and Sacramento, CA, respectively, in all disputes arising out of or relating to these Terms, our sites and site information.

Limited Time to Bring Your Claim
You agree that any cause of action arising out of related to the site or any site information must be commenced within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.
